This website is owned & operated by English Whisky Co. Limited (registered company number 01545184).

Our VAT Number is GB 363 5060 67.

Our contract with you:

You may only purchase products from this website if you are of legal drinking age in your country of residence.

All products shown on this website are subject to availability. We will inform you by e-mail as soon as possible if the product you have ordered is not available and we will refund any monies taken within 5 working days.

After you place an order, you will receive an e-mail from us acknowledging that we have received your order. We will then confirm our acceptance to you by sending you a further e-mail (Despatch Confirmation). A legally binding contract will come into existence between us and you at the point at which send you the Despatch Confirmation (Contract).

Prices and payment

Prices for our products may change from time to time, but changes will not affect any order which we have confirmed with a Despatch Confirmation.

Prices shown against each product listed are not inclusive of postage and packaging which will be added to the bill at the rates indicated.

Your postage rate will be displayed at checkout

Any products highlighted as being subject to a promotional price have previously been available at the higher indicated price on this website or in The English Distillery shop.

We accept all major credit cards. Your card is charged at the time of ordering.

When the order is placed on our website, your payment details go directly to SagePay and are encrypted on the way. We do not hold your credit card details on our computer systems or on paper.

Tax charges

All alcohol products sold on this website are sold subject to UK alcohol tax. If we are exporting products to an address in the European Union (EU), then prices are also subject to UK VAT.

NOTE: WE HAVE CURRENTLY SUSPENDED ALL OVERSEAS DELIVERIES; we will continue to review this.

For all deliveries outside of the UK your order will be subject to local sales taxes and duties upon arrival in your chosen country, which are levied at the time the package clears customs. All additional charges are the responsibility of the recipient. As customs policies vary widely from country to country we have no control over these charges, so you should contact your local customs office for further information.

Refusal to pay the local import duties and taxes will result in the products either being destroyed by customs or products being returned to us at your cost (these costs will be deducted from any refund owed by us to you when we receive the products back).

If your order is being held by your local customs office, you will be able to determine this from the information viewable through the tracking process.

At present we can only ship to the US via our importer and therefore do not give this option on our website. However all things are possible, but this one needs a discussion - so please contact us using the contact details set out above to discuss this further.

Delivery information

Note: Please do not ask us to leave your products with a neighbour if you don't get on! Amazing how many times the neighbour forgets they have taken a delivery on your behalf.

We endeavour to process your order on the next working day (although this isn't always possible).

All products will be delivered by courier, this allows you to track your products, leave an alternative place to deliver the products etc. If, during checkout you request that a signature is required, but no one is available at your address to take delivery, our courier will leave you a note that the products have been returned to our premises, in which case, please contact us to rearrange delivery.

Any parcel going abroad

NOTE: WE HAVE CURRENTLY SUSPENDED ALL OVERSEAS DELIVERIES; we will continue to review this.

Products going abroad are delivered by DHL and go specifically to the address designated and always require a signature. This is a tracked service.

We will do our best to make sure there are no mistakes in the recipient's address you supply us with but ultimately it is your responsibility to ensure we have the correct delivery address.

Delivery deadlines

Please note that we are unable to guarantee the punctuality of service provided by our delivery agents, particularly during spells of difficult weather conditions. If your shipment is delivered unacceptably late after having been collected from us on time by our agent, we will try to secure a refund where appropriate. You can of course return the product if it is no longer required.

Delivery restrictions

Orders with post box numbers (i.e., PO numbers) as delivery addresses will not be dispatched and processing will be delayed while we contact you for a valid delivery address.

British Forces Post Office (BFPO): No products with an alcohol-by-volume (ABV) over 24% may be sent to a BFPO address.

Delivery regions and costs

Your delivery cost will be displayed at checkout.

When a promotion on delivery charges is running - the promotion will apply to Zone A&B postcodes only. Zone A being all postcode areas in England and Wales, Zone B postcodes being DD, DG, EH, FK, G. KA (except KA27 & KA28), KY, ML, TD, AB 1 to AB 16. AB 21 to AB 25, AB 30, AB39, PA 1 to PA 19, PH 1 to PH 3.

When we refer to Mainland UK certain postcodes are excluded, notably a fair few Scottish postcodes are not included. Details of to where we can deliver are set out [HERE]

Delays outside of our control

If our supply of the products is delayed by an event outside our control, we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we will not compensate you for the delay. However, if the delay is likely to be substantial, you can contact us to end the Contract and receive a refund for any products you have paid for in advance, but not received. However, we reserve the right to deduct from any refund, reasonable costs we have already incurred in supplying the products.

Reasons for returning / refusing your products

You have a number of rights in terms of refusing to accept your products/ return your products. In summary they are:

  • you change your mind and no longer want the product;
  • the product is damaged when the courier arrives at your door; or
  • the product is faulty.

Changing your mind

You have 14 days from the date on which your products are delivered to change your mind and receive a refund for the products (the so-called "cooling-off period"). If you want to change your mind during the cooling-off period, please contact us by:

You will then have 14 days from telling us that you've changed your mind to return the product to us in good condition within its original packaging (and in the case of food or drink products with the container seal unopened.) You will be responsible for the cost of returning it to us.

On receipt of the product, we will refund you the price you paid for it. However, if you handle the product in a way which would not be acceptable in store, we will reduce your refund to compensate us for the product's reduced value (for example, if packaging is damaged).

In some cases, no refund will be due, and this is especially the case if the product is food or drink and the product has been opened (e.g., the seal broken on a bottle).

Note that you will have no right to change your mind in respect of any products which are:

  • clearly personalised; or
  • perishable.

If the product is damaged when the courier arrives at your door

We take a lot of care packing your order to ensure that it arrives in perfect condition. Unfortunately, there are times when parcels are damaged during transit. If a parcel shows clear signs of damage or leakage at the time of delivery, we ask that you refuse to accept the parcel. Please ask the courier to return the parcel to us. We will then despatch the order again, if possible, or refund you fully.

If the product is faulty: Any products that we send to you that are faulty or damaged, we will replace them or reimburse you for the expense, including the cost of delivery. If products are faulty or damaged, we ask that you tell us as soon as possible.

All refunds will be made as soon as possible (and in any event, within 14 days), using the same methods of payment used by you to pay.

Webshop images and descriptions

Product images on the website are intended for illustrative purposes only and may not be exact representations of the item in stock, particularly for antique and/or discontinued products, which may not be in 100% perfect condition. Please also be aware that batch numbers, vintages and bottling dates may be subject to change. If this happens, we will do our best to inform you before the item is shipped.

Intellectual property rights

In plain English – you are not allowed to use change or copy any of the wording, pictures or behind the scenes computer coding you find on this website, the only exception being that you print a hard copy of something you find on the website for you own private use, but not for commercial reasons.

All rights in all content including but not limited to copy, images, software (including code, interface and website structure) and the design, look and feel, and format of 'the site' are owned by us. You agree that you are permitted to use material and/or content only as set out in these terms. No other use is permitted without express authorisation by us in writing and, where given, you agree not to, in part or full, copy, transmit, distribute, exploit commercially, amend, translate, share with or make available to any other person any such material or content or create derivative works of such material or content.

We are the sole owners and authorised users of all trademarks, service marks, design marks, patents, copyrights, database rights, image rights for photographs contained on 'the site' and all other intellectual property appearing on or contained within 'the site' including but not limited to the page design and layout and the source code. Except where provided for under these terms, use of 'the site' does not grant any right, title, interest or license to you of any such intellectual property and any use or reproduction of the intellectual property is prohibited.

You are welcome to print hard copies of material from 'the site' solely for your lawful, personal and non-commercial use. All other copying in whatever form, whether electronic, hard copy or any other format or use for commercial purposes without our prior written consent, is prohibited. All other rights are reserved.

No photography, imagery, text, source code or any other material shown on this website (www.englishwhisky.co.uk) may be used in any circumstances for commercial purposes, nor may any of our material herein be altered, cropped, transformed, built upon, or in any other way changed or reproduced, whether from our own websites or copied from third party websites in breach of this condition themselves or otherwise redistributed without our prior written permission.

You may not engage in any price scraping or price harvesting in respect of products on 'the site' without our prior written consent.

Memberships

Where a membership subscription requires payment this will be taken on the basis of a recurring payment. To cancel your membership and therefore subsequent payments – please contact the distillery in writing (either by email or letter) or cancel online within your account with the distillery.

At point of checkout, you have the option to make a single annual payment or 4 quarterly payments. If you choose the single annual payment the payment will recur 12months later and if you choose the quarterly option then your payments will continue quarterly. Both options will continue until you notify us of your wish to terminate the Contract.

Membership benefits

Tour bookings

Bookings can be made in store at the distillery or online at www.englishwhisky.co.uk.

Tour bookings will be confirmed by email, from this point forward your tour date and time is fixed.

Tour bookings are non-refundable. However we reserve the right to cancel the tour at any time; if this should happen then your purchase will be refunded if a suitable alternative date cannot be found.

Note: our tours involve the use of stairs. If you are not able to ascend and descend stairs, please call the distillery to make alternative arrangements.

Vouchers

We sell tour & gift vouchers on our website and in our distillery shop. These vouchers can gifted or be used by the purchaser.

All vouchers currently have a 12 month expiration from date of purchase.

Any voucher used to make a booking for a specific tour becomes non-refundable. From this point forward your tour date and time is fixed. We reserve the right to cancel the tour at any time; if this should happen then your voucher is re-activated and can be used again.

The cash value vouchers (known as gift vouchers) can be used to purchase products on site at the distillery and on www.englishwhisky.co.uk. No change is given if a voucher is worth more that the products being purchased, but any remaining balance will remain to be used at a later date but no later than the expiry date.

Any vouchers purchased that are for a specific activity, cannot be used for other purposes.

Our liability to you

We are responsible for losses you suffer caused by us breaking this Contract unless the loss is:

  • unexpected, i.e., it was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable);
  • caused by a delaying event outside our control, as long as we have taken the steps set out under "delays outside of our control";
  • avoidable, i.e., something you could have avoided by taking reasonable action; or
  • a business loss, i.e., it relates to your use of a product for the purposes of your trade, business, craft or profession.

Other important terms

We can transfer our Contract with you, so that a different organisation is responsible for supplying the products. We will tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Contract.

You can only transfer your Contract with us to someone else if we specifically agree to this in writing.

This Contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

We might not immediately enforce any of our rights under this agreement (e.g., charge you interest if you are late paying us). However, that does not mean we cannot enforce any such right at a later date.

These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

Promotions

For promotions offering a free Gift Voucher or Digital Gift Card with a specific purchase, the Gift Voucher or Digital Gift Card is only redeemable where the purchase is not returned. If the purchase is returned, the Gift Voucher or Digital Gift Card will be void.

Cask 001 is excluded from all discount and promotional codes.
